Code of Good Practice on Equal Pay in Place

A code of good practice on equal pay/remuneration for work of equal value has been published in Government Gazette 38837.

The labour department drew up the code in terms of the Employment Equity Act of 1998.

The aim of the Code is to provide practical guidance to employers and employees on how to apply the principle of equal pay/remuneration for work of equal value in their workplaces.

The Code focuses on the following:

•    objectives;
•    scope;
•    legal framework and principles;
•    eliminating unfair discrimination in respect of pay remuneration;
•    evaluating jobs;
•    comparing and evaluating male- and female-dominated jobs;
•    factors justifying differentiation in pay/remuneration; and
•    process for evaluating jobs for the purpose of equal pay/remuneration for work of equal value.

Meanwhile, in notice 498 in Gazette 38843, the department has inserted rules on “repeal and savings” and “transition” into the Rules for the Conduct of Proceedings before the Commission for Conciliation, Mediation and Arbitration.

The rules were published in Gazette 38572 in March 2015.

Referrals received before 1 April 2015 will be dealt with in terms of the repealed rules while referrals received after 1 April 2015 shall be dealt with in terms of the latest version of the rules.
