Sections of Traditional Health Practitioners Act Commence

The Presidency

Certain sections of the Traditional Health Practitioners Act (2007) have been signed for commencement this month.

The act establishes the Interim Traditional Health Practitioners Council of South Africa and provides for a regulatory framework to ensure the efficacy, safety and quality of traditional health care services.

The act also provides for the management and control over the registration, training and conduct of practitioners, students and specified categories in the sector.

The sections which are effective from 1 May 2014 are the following:
•    4, 5, 6, 8, 9, 16, 17, 18-28, 29-41, 42-46, 49 and 51.

These sections deal with the establishment and governance of the council and the registration of traditional health practitioners.

The applicable sections of the act to be enacted deal with the following:
•    The objects and functions of the council.
•    Filling of vacancies in the council.
•    Disqualification criteria for council membership.
•    Council funding and the accounting officer.
•    The appointment and functions of the registrar.
•    Application procedure for registration to practice and required qualifications.
•    The registration rules and certification process.
•    Disciplinary and investigation procedures and rules.
•    Fees to be charged by registered persons.
•    Transitional provisions.

The announcement of the commencement of these sections was published in notice 29 in Gazette 37600 on 2 May 2014.

The act was assented to on 7 January 2007 and sections 7, 10, 11(3), 12 to 15, 47, 48 and 50 came into operation on 30 April 2008 in terms of an announcement made in Gazette 31020 on 30 April 2008.
