Competition Tribunal Approves Coca-Cola Merger

The Coca-Cola Company is to merge with Coca-Cola Beverages Africa (Pty) Ltd.

The economic development department announced the merger in Government Gazette 41178.

Other mergers approved by the Competition Tribunal include Gemgrow Properties Ltd and ERF 266 In Respect of Multiple Property Letting Enterprises, the Spar Group Limited and Fifth Season Investments 126 (Pty) Ltd and Steinhoff Doors and Building Materials (Pty) Ltd.

In Notice 813 in the same gazette, the Tribunal has also published a list of complaint referrals.

The Competition Commission alleges that the respondents engaged in a prohibited practice in terms of the Competition Act.

Respondents include Stuttaford Van Lines Gauteng Hub (Pty) Ltd, Hoegh Autoliners Holdings AS (Ford) and BEEFCOR (Pty) Ltd.

Meanwhile, the department, in Gazette 41178, has announced that the National Hospital Network (NHN) has applied to the Competition Commission for an extension of its current exemption from certain provisions of Chapter 2 of the act.

The current exemption lapses on 31 December 2017.

NHN also seeks a further exemption from the act focused on engaging on behalf of its members in global fee negotiations with medical schemes, administrators, the state and healthcare providers (professional associations) and to undertake collective or centralised procurement.

The exemptions are requested until 31 December 2022.

Comment is invited within 20 business days of the date of publication.

The department recently briefed parliament on its 2016/17 annual report.

Draft new proposals for Youth Employed Accord II have been developed.

A Draft report on the Youth Employment Accord had also been completed.
