Competition Commission to Amend Access to Information Rules

Amendments are proposed to Regulation 15 of the Competition Commission Rules.

The economic development department published the draft rules in Government Gazette 42030 for comment.

Rule 15 focuses on access to information.

According to the department, the aim of the draft amendments is to bring Rule 15 in line with section 7 of the Promotion of Access to Information Act (PAIA) of 2000 as the policy considerations contained in section 7 of the PAIA justifies the introduction of similar qualifications in Rule 15.

The proposed amendments stipulate that sub-rule (1) does not apply to a record if that record is requested in relation to civil or criminal proceedings or proceedings before an administrative body, including the Competition Tribunal, and after the commencement of the proceedings.

Records obtained in contravention of the proposals will not be admissible as evidence unless the court or administrative body concerned determines that exclusion of the records would be detrimental to the interests of justice.

Comment is invited within 30 days of the date of publication.
